TERMS & CONDITIONS
Concord Wheels – Consignment Terms & Conditions
These Consignment Terms & Conditions (“Terms”) apply to all vehicles listed, marketed, and sold by Concord Wheels (“the Dealer”) on behalf of private vehicle owners (“the Consignor”). By submitting a vehicle for consignment, the Consignor agrees to the following:

1. Vehicle Ownership & Authority
1.1 The Consignor confirms that they are the lawful owner of the vehicle or are authorised to act on behalf of the lawful owner.
1.2 The Consignor must provide valid proof of ownership, identification, and any supporting documents requested by the Dealer.
1.3 The Consignor warrants that the vehicle is free of any undisclosed finance, liens, or legal claims.
2. Vehicle Condition & Disclosure
2.1 The Consignor agrees to fully disclose the vehicle’s condition, service history, accident history, mechanical issues, non-functional features, and any material defects.
2.2 Concord Wheels is not responsible for undisclosed issues and may recover any losses arising from misrepresentation.
2.3 The Dealer may conduct a basic inspection; however, this is not a diagnostic assessment and does not constitute a warranty.
3. Pricing & Negotiation
3.1 A mutually agreed selling price or price range will be set in writing before the vehicle is listed.
3.2 The Dealer may negotiate within this range unless otherwise instructed by the Consignor.
3.3 Any offer below the minimum agreed price will be presented to the Consignor for approval.
4. Dealer Commission & Fees
4.1 Concord Wheels charges a commission on successful sale; the rate will be agreed in writing prior to listing.
4.2 Any additional marketing, detailing, mechanical preparation, or admin fees will also be agreed upon before commencement.
4.3 Commission and fees are deducted from the final selling amount before payment to the Consignor.
5. Marketing & Handling of the Vehicle
5.1 The Dealer is authorised to market, advertise, photograph, and showcase the vehicle across its website, showroom, and third-party platforms.
5.2 If the vehicle remains in the Consignor’s possession during the consignment period, the Consignor must keep it clean, available for viewing, and in substantially the same condition as at the start of the agreement.
5.3 If the vehicle is kept at the dealership, Concord Wheels will take reasonable care but is not liable for damage caused by unforeseen or external events (e.g., weather, theft, third-party negligence).
6. Test Drives & Demonstration
6.1 The Dealer may conduct test drives or demonstrations with potential buyers.
6.2 If the vehicle remains in the Consignor’s possession, they must make the car available for scheduled inspections or test drives.
6.3 Concord Wheels will ensure that all prospective buyers are accompanied by a staff member unless agreed otherwise.
7. Insurance & Risk
7.1 The vehicle remains at the Consignor’s risk at all times.
7.2 The Consignor must maintain comprehensive insurance on the vehicle for the duration of the consignment period.
7.3 Concord Wheels is not responsible for accidental damage, loss, theft, or mechanical failure unless caused by proven negligence of the Dealer.
8. Finance & Documentation
8.1 If the vehicle is financed, the Consignor must disclose the settlement value and provide the finance institution’s contact details.
8.2 Settlement amounts will be paid directly to the bank upon sale, and the balance (less commission and fees) will be paid to the Consignor.
8.3 The Consignor agrees to provide all necessary documents required for transfer of ownership.
9. Payment to Consignor
9.1 Payment to the Consignor will be made within X business days (customise) after the Dealer receives full cleared funds from the buyer.
9.2 No payment will be made until the dealer has confirmed settlement of any outstanding finance.
10. Duration & Termination
10.1 The standard consignment period is X days (customisable), unless agreed otherwise.
10.2 Either party may terminate the agreement with written notice of 48 hours, provided there is no active sale in progress.
10.3 If the Consignor withdraws the vehicle while a confirmed buyer offer is in place, a cancellation fee may apply.
11. Liability & Indemnity
11.1 Concord Wheels acts solely as an intermediary and does not guarantee the sale of any vehicle.
11.2 The Consignor indemnifies the Dealer against losses arising from misrepresentation, undisclosed defects, or disputes regarding ownership.
11.3 The Dealer is not liable for any indirect, consequential, or financial losses arising from the consignment arrangement.
12. Acceptance of Terms
By submitting a vehicle for assessment, listing, or marketing, the Consignor acknowledges that they have read, understood, and agree to these Terms & Conditions.
